The rules that made this manoeuvre illegal were only introduced after this pass. Therefore I can't agree that he should have been black flagged.

Fact: the driver went completely off the track and cut off a corner of the S curve while attempting a pass.
There has always been a penalty for this action. It was the race stewards that messed up by failing to apply the pre-existing rule.

Blocking? Thats the RACE LINE through turn 9 and he gave Herta plenty of room, a block is when you move OUT of the racing line to prevent someone from passing.
